Is it unlawful to disclose info on patrons’ dining habits?

Judgment for defendant is reversed and questions of law are certified concerning whether, under the common law tort of intrusion upon seclusion, a business may be held liable when it discloses to a third person its customer’s credit card information or details about its patrons’ dining habits.
